Visa Guideline
This section outlines considerations for international applicants holding H-1B or O-1 visa classifications and their dependents.
Students on H-1B Visas
- Study must be incidental to the alien’s employment as an H-1B nonimmigrant and not the primary purpose for remaining in the U.S.
Dependents of H-1B Visa (H-4 Status)
- May study in the U.S., full- or part-time.
- Not eligible for F-1 visa employment benefits such as on-campus employment or practical training.
Students on O-1 Visas
- Study must be incidental to the alien’s employment as an O-1 nonimmigrant and not the primary reason for remaining in the U.S.
Dependents of O-1 Visa (O-3 Status)
- Employment is prohibited for O-3 dependents.
- Study is permitted, provided the program does not include employment-related activities such as co-ops or assistantships.
Florida Residency for Tuition Purposes
- H-1B and H-4, as well as O-1 visa holders, may be eligible to establish Florida residency for in-state tuition.
- Residency requests must be based on the student’s own immigration status (e.g., EA card, I-797 form).
- If the student is in a dependent status (e.g., H-4), both the student’s and the parent’s immigration documentation must be submitted.
- Florida ID requirements must also be met, based on the claimant (usually the parent or guardian) unless the student qualifies as independent.
